Terms & Conditions

Summary

Welcome to Qerrier! By using our service, you agree to these terms. Here are the most important points:

  • We are an intermediary: We provide the platform to connect you, but we aren't part of your transaction.
  • Secure Payments: We hold the Requester's payment in escrow (a secure hold) via Stripe and only release it when the handover is confirmed with the Exchange Code.
  • No Illegal Items: You are 100% responsible for ensuring your item is legal to transport and for paying all required GST. Do not use Qerrier for prohibited items (like tobacco or weapons).
  • Disputes: You agree to resolve any disputes about items (e.g., quality, wrong item) directly with the other user. Qerrier provides the tools (chat, Exchange Code) but does not mediate these disputes.
  • Cancellations: Requesters can cancel for free within 6 hours of payment (before a receipt is submitted). After that, a fee applies, which includes 50% of the Carrier's reward plus platform and processing costs.
  • Meet Safely: We strongly recommend in-person, public meetups. We are not liable for issues from non-in-person handovers.

Welcome to Qerrier! These terms and conditions ("Terms") outline the rules and regulations for the use of the Qerrier platform and all related services (collectively, the "Service").

1. Acceptance of Terms

By accessing or using the Service, making an offer, or accepting a job, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all other guides and policies referenced herein. If you do not agree, you may not use the Service.

2. The Service

Qerrier provides a peer-to-peer platform to connect "Requesters" seeking to acquire items from overseas with "Carriers" who are traveling and willing to purchase and transport those items in exchange for an agreed-upon reward. Qerrier acts solely as a technology intermediary and payment facilitator and is not a party to any transaction or agreement between users.

2.1. Permitted & Prohibited Items

You agree not to request or carry any items on our Prohibited Items List. This includes, but is not limited to, illegal drugs, weapons, counterfeit goods, restricted agricultural products, tobacco, alcohol in excess of duty-free limits, and any other item prohibited by the laws of the departure or arrival country. You are solely responsible for all customs declarations and any associated fees or taxes (e.g., GST).

3. Payments, Fees, and Cancellations

Our payment system, provided by our third-party partner Stripe, is designed to protect both parties. When a Requester authorizes a payment, the funds are held securely by Stripe (as a "payment hold") and are not released to the Carrier until the transaction is successfully completed.

3.1. Fees

For Requesters: You agree to pay the agreed-upon item cost, the Carrier's reward, and a service fee. The full, final amount (including all taxes and fees) will be shown to you before you authorize the payment hold.

For Carriers: You will receive the full agreed-upon item cost (for reimbursement) and your reward, minus a small service fee. This fee supports the platform and covers transaction processing costs.

3.2. Cancellations

Free Cancellation Window: Requesters may cancel a confirmed job for a full refund of their payment hold, for any reason, within 6 hours of the initial payment authorization. This grace period applies only to cancellations made *before* the Carrier has submitted a receipt.

Fee-Based Cancellations: A cancellation by the Requester after the 6-hour grace period (or at any time after the Carrier has submitted a receipt) will incur a fee. This fee is not a penalty but is used to compensate the Carrier and cover non-refundable platform and processing costs. The total fee consists of:

The total fee will be calculated and displayed to you before you confirm the cancellation. This amount will be captured from your payment hold, and the remainder will be released.

Carrier Cancellations: Cancellations initiated by a Carrier after accepting a job are monitored. Unilateral cancellations by a Carrier after purchasing an item are a severe policy violation and may result in account suspension and financial responsibility for the purchased item.

4. The Handover Process

For the safety and security of all users, Qerrier strongly recommends in-person, public meetups for the final handover. Qerrier is not liable for issues, loss, or disputes arising from non-in-person delivery methods (e.g., mail, courier services, or drop-offs).

The transaction is finalized when the Requester provides the 6-digit Exchange Code to the Carrier, who must enter it into the app. This code signifies that the Requester has inspected and accepted the item. Do not share this code until you have your item. Providing the code is final and releases the payment.

5. Disputes Between Users

Qerrier is a platform and not a party to the transaction. You acknowledge and agree that any dispute, claim, or controversy arising from your transaction (including but not limited to item quality, authenticity, damage, or deviation from the request) is solely between you and the other user.

6. Qerrier Support

Qerrier provides customer support for platform-related issues only. This includes, but is not limited to, technical errors, payment processing failures, payout delays, or cases of user harassment or abuse. Support for item-related disputes is not provided, as outlined in Section 5.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Qerrier (including its officers, directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; (c) any content obtained from the Service; (d) unauthorized access, use, or alteration of your transmissions or content; or (e) any dispute between you and any other user of the Service.

8. Indemnification

You agree to defend, indemnify, and hold harmless Qerrier and its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service; (b) your violation of any term of these Terms; (c) your violation of any law or the rights of a third party, including without limitation any customs regulations, tax laws, or privacy rights; or (d) any claim that your actions or the items you requested or carried caused damage to a third party. This indemnification obligation will survive these Terms and your use of the Service.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Singapore to resolve any dispute or claim arising from these Terms or the Service.

10. Account Termination

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms or engage in any activity that we, in our sole discretion, deem harmful to the Service or other users. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice (e.g., via email or an in-app notification) prior to the new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
